These terms of use ("Terms") govern access to the neijems.com website and the use of the private chauffeur transport booking service operated by Neijems Sàrl, a Swiss limited liability company (Sàrl) with its registered office in the canton of Vaud. Any booking implies unreserved acceptance of these Terms.

1. Purpose and scope

These Terms define the conditions under which Neijems Sàrl provides its booking website and its private chauffeur transport services. They apply to anyone (the "Customer") using the website to request or book a ride. By submitting a request, the Customer acknowledges having read and accepted these Terms.

2. Services

Neijems Sàrl provides a private chauffeur transport service aboard a Volvo XC90 (up to 6 passengers): airport and station transfers, intercity trips, chauffeur hire and long-distance journeys, in Switzerland and Europe. The service is available 7 days a week; bookings are open from 04:00 to 23:30.

3. Booking and formation of the contract

The Customer enters the pick-up location, destination, date, time, number of passengers and luggage. The fare is calculated and displayed immediately, then the Customer is redirected to the secure payment. The transport contract is formed upon actual payment: the Customer then receives a confirmation with a unique booking number, and the chauffeur is notified without delay. No account is required to book. Rides are only possible between 04:00 and 23:30; no pick-up is offered between 23:30 and 04:00. Where the requested slot is already taken by another ride, the Customer is informed before payment, with an estimate of the possible delay to their pick-up; they must expressly accept that delay in order to proceed. Neijems Sàrl endeavours to keep to the agreed time, with a buffer of about 20 minutes between rides.

4. Prices and fare calculation

Prices are shown in Swiss francs (CHF). The fare is calculated based on road distance at a rate of CHF 4 per kilometre. One item of luggage per passenger is included; each additional bag is charged CHF 2.50. A night fare applies: the ride amount is multiplied by two (×2) for any pick-up between 04:00 and 06:00. The final amount, recalculated and displayed before payment, prevails. Where applicable, Swiss VAT is included in the stated price.

5. Capacity and luggage

The vehicle carries up to 6 passengers. For safety and comfort, luggage capacity depends on the number of passengers: up to 7 large suitcases for 4 passengers, 5 for 5 passengers and 2 for 6 passengers. Neijems Sàrl reserves the right to decline any request exceeding the vehicle's capacity.

6. Payment

Payment is made online, in CHF, by card, through a secure payment provider (SumUp). It is requested at the time of booking; the ride is confirmed only once payment has been verified. Neijems Sàrl neither collects nor stores any card data, which is handled directly by the payment provider. The booking is confirmed only after payment verification.

7. Cancellation and refunds

Swiss law provides no statutory cooling-off period for a booking concluded online (art. 40a CO only covers doorstep and telephone solicitation). Neijems Sàrl nevertheless applies the following policy as a commercial commitment. Goodwill withdrawal: any paid booking may be cancelled free of charge within one hour of payment, provided pick-up is not scheduled within the next 3 hours. Beyond that, the following scale applies based on the time remaining before pick-up: more than 24 hours before, full refund (100%); between 24 hours and 2 hours before, 50% of the amount is refunded and 50% retained as a cancellation fee; less than 2 hours before pick-up, or in the event of a no-show, no refund is due. If the ride is cancelled by Neijems Sàrl or the chauffeur, the Customer is refunded in full. The Customer cancels via the secure link in their confirmation email; the refund amount is displayed before any confirmation. Refunds are issued automatically to the payment method used for the booking and may take a few business days to appear on the Customer's account.

8. Customer obligations

The Customer undertakes to provide accurate and complete information (addresses, time, contact details, flight number where applicable), to be present at the agreed place and time, and to respect the vehicle and the chauffeur. Carrying dangerous or illegal goods is prohibited. Any damage caused to the vehicle by the Customer may be charged to them.

9. Liability

Neijems Sàrl uses reasonable means to ensure a punctual, safe and professional service. It cannot be held liable in the event of force majeure, exceptional traffic or weather conditions, road closures, or inaccurate information provided by the Customer. To the extent permitted by Swiss law, the liability of Neijems Sàrl is limited to the amount of the ride concerned.

10. Delay and waiting time

If the Customer is late at the pick-up location, a reasonable waiting time may be granted. Beyond that period, the ride may be treated as a "no-show" under section 7. The exact waiting-time conditions are communicated to the Customer at the time of booking.

11. Data protection

Personal data collected during booking is processed in accordance with the Swiss Federal Act on Data Protection (FADP/nLPD) and, where it applies, the General Data Protection Regulation (GDPR). Details are set out in the Privacy Policy.

12. Intellectual property and website design

All website elements (text, photographs, logo, layout) are protected and remain the property of Neijems Sàrl or its rights holders. The website was designed, developed and built by MYPA PROD. Any reproduction without authorisation is prohibited.

13. Changes to the Terms

Neijems Sàrl reserves the right to amend these Terms at any time. The version applicable to a booking is the one in force when the Customer submits the request.

14. Governing law and jurisdiction

These Terms and the services of Neijems Sàrl are governed by Swiss law. The place of jurisdiction is the registered office of Neijems Sàrl, in Romanel-sur-Lausanne, canton of Vaud, subject to mandatory consumer-protection provisions.
